Defects in service of a tax payment notice (cartella) are the first grounds for invalidity to check whenever you receive a document from the Italian Tax Collection Agency (ADER). A notice served irregularly is treated as though it had never been served: the 60-day time limit for appealing does not begin to run and any limitation period applicable to the debt is not interrupted.
What are the main defects in service?
The case law of the Italian Supreme Court (Corte di Cassazione), including its orders issued in 2025–2026, has established a list of defects that render service of a tax payment notice (cartella) void or non-existent.
- Service at an address other than the registered residential address: void if the taxpayer had moved before service and had notified the municipality (Cass. 12715/2024).
- Service on the caretaker without a CAD (notice of deposit): the caretaker is authorised to accept service only if the addressee is absent; a subsequent notification by registered post must always be sent under art. 7 L. 890/1982.
- Missing service report: the service report is an essential official document; without it, service is non-existent and cannot be cured.
- Service by certified email (PEC) at an address not listed in public registers: for businesses and professionals, the PEC address must be the one registered in INI-PEC; service by PEC on private individuals is not permitted.
- Service on a dissolved company or a company struck off the Companies Register: void if effected more than 5 years after the company was struck off.
- Failure to complete service where the addressee cannot be located: deposit at the town hall and the posting of a notice are always required, in addition to notification by registered post.
The difference between void and non-existent service
The distinction is crucial to the defence.
- Void service: an act of service exists but is defective. It can be cured by the addressee entering an appearance in the proceedings or by service being effected again.
- Non-existent service: there is no act capable of being classified as service (e.g. delivery to an unknown person or at an entirely incorrect address). It cannot be cured.
The Joint Divisions (Sezioni Unite) of the Italian Supreme Court (Corte di Cassazione) (no. 14916/2016) clarified that non-existence is a residual category; most defects fall within the category of curable invalidity.
How to check whether service was valid
Before appealing, it is essential to request an extract from the tax collection roll and a complete copy of the service report from the Italian Tax Collection Agency (ADER). The request can be made at the counter or by PEC; the Agency has 30 days to respond under art. 26 DPR 602/1973.
Documents to examine:
- The service report, including the date, the capacity of the person accepting delivery and the signature.
- The acknowledgement of receipt card (AR), if service was effected by post.
- The notice of deposit (CAD), if service was effected on the caretaker or where the addressee could not be located.
- The taxpayer's residential address history for the period when service took place.
Time limits for appealing on grounds of defective service
If service of the notice is defective, the 60-day time limit does not begin to run. However, caution is required: if the taxpayer becomes aware of the document through a subsequent measure (a demand for payment, an administrative vehicle restriction, a mortgage registration or an attachment), they must appeal within 60 days of service of that subsequent measure, raising the defect in the underlying notice in those proceedings.
Frequently Asked Questions
Is a notice served on a private individual by PEC valid?
No. Service by PEC is permitted only on persons and bodies required to have a PEC address listed in public registers (businesses, professionals and public authorities). Private individuals must be served by post or through a bailiff.
What should I do if I have received only the acknowledgement of receipt card without the notice?
Immediately request a complete copy of the document and the service report from the Italian Tax Collection Agency (ADER). Without the contents of the notice, it is impossible to assess either whether a debt is owed or how much is owed.
Does defective service also mean that the debt becomes time-barred?
Yes. Void or non-existent service does not interrupt the limitation period for the debt. For social security debts and local taxes, the limitation period is 5 years; a notice that has never been properly served is often already time-barred.
