Appealing a Tax Payment Notice (Cartella)
A tax payment notice (cartella) issued by the Italian Tax Collection Agency (ADER) is the instrument demanding payment of sums entered on the collection roll. It often involves defects in service, expired limitation periods or missed statutory deadlines that allow it to be annulled in full: taking action within 60 days is essential.
In Brief
A tax payment notice (cartella) must be appealed within 60 days of service before the Tax Court (Corte di Giustizia Tributaria) for taxes, or the ordinary courts for contributions and administrative penalties. The most frequent grounds for annulment are defects in service of the tax payment notice or the underlying instruments, expiry of the limitation period for the debt, failure to meet the deadlines for entry on the collection roll, and failure to serve the tax assessment notice.
What a Tax Payment Notice (Cartella) Is and What It Contains
A tax payment notice (cartella) (now more accurately termed "cartella di pagamento") is the instrument by which the Italian Tax Collection Agency (ADER), at the request of one or more creditor bodies (the Italian Revenue Agency (Agenzia delle Entrate), INPS, municipalities or regions), demands payment of sums entered on the collection roll. It contains the debtor's identification details, references to the underlying instruments, the amount due, penalties, late-payment interest and the collection fee.
Contrary to popular belief, a tax payment notice (cartella) is not always a final instrument: in many cases it can be appealed, and an appeal also allows defects in earlier instruments that were never served on the taxpayer to be raised (a so-called "combined appeal" under art. 19, comma 3, D.Lgs. 546/1992).
Defects That Allow a Tax Payment Notice (Cartella) to Be Annulled
The Firm's experience shows that a significant proportion of tax payment notices (cartella) contain identifiable procedural or substantive defects. A thorough technical review is the basis of any effective defence.
Defects in Service of the Tax Payment Notice (Cartella)
Service at an incorrect address, at a former residence, on an unauthorised person, or in breach of the formalities under L. 890/1982 and D.P.R. 602/1973. Invalid service renders the instrument legally non-existent.
Failure to Serve the Underlying Instruments
If the tax assessment notice or the instrument underlying the tax payment notice (cartella) was never served, the taxpayer may challenge both the tax payment notice and the underlying instrument in a single appeal.
Expiry of the Limitation Period for the Debt
Limitation periods vary by type: 5 years for social security contributions, administrative penalties and local taxes; 10 years for central government taxes (with divergent case law).
Expiry of the Deadline for Entry on the Collection Roll
art. 25 of D.P.R. 602/1973 sets strict deadlines for service of the tax payment notice (cartella), failing which the right to pursue collection lapses.
Inadequate Statement of Reasons and Failure to Identify the Officer Responsible for the Procedure
The tax payment notice (cartella) must identify the underlying instrument, the grounds for the claim and the officer responsible for the procedure (art. 7, L. 212/2000).
Calculation Errors or Duplications
Amounts already paid, debt cancellations not reflected in the notice, overlaps with other instruments, and incorrect calculation of interest and penalties.
Which Court to Apply to: Tax, Ordinary or Labour Court
Jurisdiction depends on the nature of the debt entered on the collection roll. This is a sensitive issue: filing an appeal before the wrong court results in inadmissibility or the need to resume proceedings before the competent court, with a risk of missing the deadlines.
Tax Court (Corte di Giustizia Tributaria)
For national taxes (personal income tax (IRPEF), corporate income tax (IRES), VAT, registration tax), local taxes (municipal property tax (IMU), TARI, TASI), vehicle tax and the RAI licence fee. Time limit: 60 days from service.
Labour Court
For tax payment notices (cartelle) relating to social security and welfare contributions (INPS, INAIL, professional pension funds). Time limit: 40 days from service.
Justice of the Peace or Ordinary Court
For non-tax administrative penalties (Road Traffic Code, administrative fines). Time limits vary depending on the type of penalty.
Suspending the Tax Payment Notice (Cartella) and Halting Collection
Once served, the tax payment notice (cartella) becomes enforceable after 60 days: the Italian Tax Collection Agency (ADER) may attach wages, bank accounts and property, and impose administrative vehicle seizures (fermo amministrativo). To prevent these measures, it is possible to apply for a judicial suspension under art. 47 D.Lgs. 546/1992 (in tax proceedings) or art. 615 c.p.c. (in ordinary court proceedings), demonstrating that the appeal has merit and that there is a risk of irreparable harm.
Through the administrative procedure, art. 1, commi 537-543, della L. 228/2012 allows an application to the Italian Tax Collection Agency (ADER) for a statutory suspension of collection, supported by documentation demonstrating that the debt is time-barred, has been paid or cancelled, or is covered by a favourable judgment. A response must be provided within 220 days: otherwise, the tax payment notice (cartella) is automatically cancelled. This procedure is often underestimated but is extremely effective where there is strong documentary evidence.
Preferential Settlement and Tax Amnesty Settlement (Rottamazione): Opportunities to Assess
From time to time, the legislature introduces preferential settlement measures for debts referred for collection, known as tax amnesty settlements (rottamazione), which allow the debt to be discharged by paying only the principal and statutory interest, without penalties or late-payment interest. These opportunities require careful assessment: defects in the tax payment notice (cartella) may make an appeal preferable, whereas in cases of clear breaches or small amounts, a tax amnesty settlement (rottamazione) is often the more rational choice.
The Firm Marzo Associati assesses the balance between dispute-resolution procedures, tax amnesty settlement (rottamazione) and an appeal on a case-by-case basis, tailoring the strategy to the amount claimed, the strength of the grounds of challenge and the client's financial objectives.
