Tax Litigation

Debts with the Italian Tax Collection Agency (ADER)

Tax payment notices (cartella), demands for payment, administrative vehicle seizures (fermo amministrativo), tax mortgages (ipoteca) and attachments by the Italian Tax Collection Agency (ADER) (formerly Equitalia) can be blocked, reduced or cancelled. Specific technical mechanisms are available: the quinquies tax amnesty settlement (rottamazione), payment plans of up to 120 instalments, statutory suspension under L. 228/2012, appeals with applications for a stay and actions based on limitation. Choosing the appropriate mechanism requires a technical assessment on a case-by-case basis.

    In Brief

Debts with the Italian Tax Collection Agency (ADER) can be managed using five main mechanisms: (1) ordinary payment plans of up to 120 instalments for debts, subject to documented financial difficulties; (2) the quinquies tax amnesty settlement (rottamazione) (Legge di Bilancio 2026), which eliminates penalties and late-payment interest; (3) statutory suspension under L. 228/2012 where the debt is time-barred, paid or discharged; (4) an appeal with an application for a stay within 60 days of service of the tax payment notice (cartella); (5) a limitation defence (5 or 10 years) for older debts. The choice depends on the age of the debt, the existence of defects and the taxpayer's financial position.

Overview of Mechanisms for Managing Debts with the Italian Tax Collection Agency (ADER)

When a taxpayer accumulates debts with the Italian Tax Collection Agency (ADER), the most common mistake is to ignore tax payment notices (cartella) or accept the first instalment plan offered without a preliminary analysis. In many cases, this choice crystallises a debt that could have been cancelled in whole or in part using the appropriate technical mechanisms.

The Marzo Associati Firm follows a three-stage methodology: obtaining the complete extract from the collection roll, analysing limitation periods and defects in service for each individual tax payment notice (cartella), and devising a strategy combining appeals, suspension, tax amnesty settlement (rottamazione) and instalment payments in a way consistent with the client's financial position and objectives.

Ordinary Instalment Plans: How They Really Work

An instalment plan allows the debt to be spread over up to 120 monthly instalments (10 years). For debts of up to €120,000, the application is processed automatically and requires no documentation. Above this threshold, temporary financial difficulties must be demonstrated through the ISEE, liquidity ratios and a statement of financial position.

Please note: submitting an application for an instalment plan amounts to an acknowledgement of the debt and interrupts the limitation period. For this reason, before arranging instalments, it is essential to check whether the debt is time-barred or has defects that would allow it to be cancelled in full.

    • Loss of Entitlement to an Instalment Plan

Failure to pay 8 instalments, even if not consecutive (5 in some cases).

    • Effects on Collection

An instalment plan with payments up to date blocks enforcement action (attachments, administrative vehicle seizures (fermo amministrativo) and tax mortgages (ipoteca)).

    • Offsetting Tax Credits

The taxpayer's tax credits may be offset against the debt being paid in instalments.

Quinquies Tax Amnesty Settlement (Rottamazione) 2026: Who Really Benefits

The quinquies tax amnesty settlement (rottamazione), introduced by Legge di Bilancio 2026, allows debts entrusted to the Italian Tax Collection Agency (ADER) to be settled by paying only the principal and statutory interest, without penalties or late-payment interest. The average effective reduction is between 30% and 50% of the amount entered on the collection roll.

A tax amnesty settlement (rottamazione) is worthwhile when the debt is certain, well documented and free from defects. It is not worthwhile where there are strong limitation defences or defects in service: in those cases, an appeal may lead to full cancellation, whereas a tax amnesty settlement (rottamazione) still requires payment of the principal.

Statutory Suspension under L. 228/2012: The Most Underused Mechanism

art. 1, commi 537-543, of L. 228/2012 allows taxpayers to ask the Italian Tax Collection Agency (ADER) for an administrative suspension of collection by submitting documentation demonstrating that the debt is time-barred, has been paid or discharged, is subject to a favourable judgment or is not due for another reason. The Italian Tax Collection Agency (ADER) must forward the request to the creditor body and obtain a response within 220 days.

If the body does not respond within this period, the debt is automatically cancelled through tacit approval. It is a cost-free, swift and highly effective mechanism in cases supported by solid documentation: the Firm systematically uses it as the first line of defence where the conditions are met.

    When an Appeal Is Preferable

An appeal before the Tax Court (Corte di Giustizia Tributaria) (for taxes) or the ordinary court (for contributions and penalties) within 60 days of service of the tax payment notice (cartella) is the principal route where the claim has substantive defects: invalid service, expiry of the limitation period, expiry of a statutory deadline, failure to serve the underlying decision or calculation errors.

As part of the appeal, it is possible to apply for a stay under art. 47 D.Lgs. 546/1992: if the judge finds fumus boni iuris and periculum in mora, they may suspend the enforceability of the tax payment notice (cartella) pending judgment, blocking attachments and administrative vehicle seizures (fermo amministrativo).

How to Stop an Attachment Already Underway

Once an attachment has been served, the available mechanisms are: an objection to enforcement under art. 615 c.p.c. (to contest the right to proceed); an objection to enforcement measures under art. 617 c.p.c. (for formal defects); an application to substitute a cash payment for the attached assets under art. 495 c.p.c., offering a sum of money; and a documented request for administrative suspension.

Statutory limits apply to attachments of wages or pensions (one fifth of earnings, protected thresholds for minimum pensions). For attachments of bank accounts, it is essential to act within a few days to prevent the attachment of the funds from becoming final.
