    The New Legislative Framework

The decree reforming public gambling, awaited for years, has finally been approved, introducing a new regulatory framework for the entire sector. We examine the main changes affecting concession holders.

    New Concessions

    Duration and Requirements

The new concessions will have a nine-year term, with the possibility of renewal for a further 4 years subject to meeting specific KPIs. The minimum capital requirements have been significantly increased.

    Tender Procedures and Awards

A new round of tender procedures for the award of concessions is planned, with selection criteria favouring:

    • Financial soundness

    • Experience in the sector

    • Local investment plans

    Tax Regime

    New Taxation

The tax levy is being restructured, with different rates for each type of gambling:

    • Sports betting: 24% on stakes

    • Online gaming: 25% on the margin

    • Gaming machines: new taxation parameters

    Single Tax

A single substitute tax is being introduced to simplify tax compliance for operators.

    Player Protection

    Single Register of Self-Excluded Players

Creation of a single national register of self-excluded players, accessible to all operators in real time.

    Betting Limits

Introduction of maximum weekly and monthly betting limits, which players can customise but which are subject to caps that cannot be exceeded.

    Geographical Distribution

    Retail Outlets

New rules for the geographical distribution of physical retail outlets, with increased minimum distances from sensitive locations.
