Erroneous Tax Payment Notice: How to Challenge a Debt Not Owed

An "erroneous tax payment notice" is one issued by mistake: double taxation, incorrect amounts or a debt already paid. There are 3 ways to challenge it quickly.

"Erroneous tax payment notice" is the term taxpayers use to describe tax payment notices (cartelle) issued by mistake: amounts already paid, duplicate entries on the tax collection roll, mistaken identity, or taxes no longer due because they are time-barred or have been discharged. The Taxpayer's Ombudsman has repeatedly highlighted this issue; in 2026, rapid procedures are available to obtain their cancellation.

Typical cases of erroneous tax payment notices

      • Duplicate entry on the tax collection roll: the same debt notified twice (e.g. on an ordinary and an extraordinary collection roll).
      • Payment already made: the payment has not been recorded because of a matching error.
      • Mistaken identity: a notice addressed to someone with the same name or to a person who died years ago.
      • Tax not due: e.g. vehicle tax for a scrapped vehicle, or TARI waste tax for a property not held by the taxpayer.
      • Discharge not reflected: a discharge granted by the taxing authority has not been communicated to the Collection Agent.
      • Inflated amounts: penalties or interest calculated incorrectly.

    Three ways to challenge it

    1. Self-correction request (autotutela) to the creditor authority

A self-correction request (autotutela) is the quickest remedy and is free of charge. A reasoned application is submitted to the authority that issued the collection roll (Italian Revenue Agency (Agenzia delle Entrate), municipality, INPS (Italian social security institute)), requesting cancellation or correction of the notice. The authority must respond within 90 days (art. 10-quater of the Taxpayer's Charter, as amended by D.Lgs. 219/2023).

    Documents to attach:

      • Tax payment notice (cartella).

      • Evidence of payment or entitlement to discharge (receipts, F24 forms, judgments, discharge decisions).

      • Substitute declaration under DPR 445/2000.

    2. Statutory suspension under L. 228/2012

The application must be submitted to the Italian Tax Collection Agency (ADER) within 60 days of service of the notice, citing one of the seven exhaustively listed grounds. Effect: automatic suspension of collection until the authority responds. Once 220 days have elapsed from the application without a response, the debt is cancelled by deemed consent.

    3. Appeal to the Tax Court (Corte di Giustizia Tributaria)

Where a self-correction request (autotutela) and statutory suspension do not resolve the matter, the notice is challenged within 60 days of service. Jurisdiction lies with the Tax Court (Corte di Giustizia Tributaria) for the place of tax domicile. Self-representation is permitted for amounts up to 50,000 euros, but assistance from a tax lawyer is always advisable.

    Realistic timescales

For a manifestly incorrect notice, average timescales are:

      • Self-correction request (autotutela): 60-120 days from the application.
      • Statutory suspension: immediate halt; response within 220 days.
      • Appeal to the Tax Court (Corte di Giustizia Tributaria): 12-18 months for the first-instance judgment.

Recommended strategy: submit a self-correction request (autotutela) + an application for statutory suspension in parallel; if neither receives a response, lodge an appeal by the 60th day.

    Frequently Asked Questions

Can I ignore a manifestly incorrect notice?

No, never. Even erroneous tax payment notices become final if they are not challenged within 60 days, entitling the Italian Tax Collection Agency (ADER) to impose vehicle restrictions, register charges over property and carry out attachments. A notice must always be formally challenged.

Can I recover the costs incurred in defending my case?

Yes. If the appeal is upheld, the court orders the administration to pay the litigation costs. In the self-correction request (autotutela) procedure, if the error was manifest, damages may be sought under art. 2043 c.c.

Who is liable for damage (e.g. attachment based on a notice subsequently cancelled)?

The taxing authority is liable for the original error; the Italian Tax Collection Agency (ADER) is liable only if it acted intentionally or with gross negligence in handling the matter. Damages are sought before the ordinary courts.
